Lodholz North Star Acres makes no warranty of merchantability or other warranties, express or implied. All material is sold as being true to form and species and is shipped in good condition. All orders are subject to crop conditions and on condition that the order is void shall injury befall our stock from hail, fire, frost, inventory error or other causes beyond our control.

TERMS

All shipments are F.O.B. Tomahawk, Wisconsin 54487

• All shipments are 25% down and balance before shipment. In the event purchaser fails to comply with payment, seller shall charge interest of 1 1/2% per month or 18% per annum from the date of receipt of merchandise.
• Every effort will be made to ship merchandise to buyer's location on date requested; however, any delays due to weather or conditions beyond seller's control, will not be considered default in this contract.
• We guarantee the product will arrive in the best condition possible.
• We do not guarantee merchandise for improper planting procedures, herbicide applications, extremes of weather, extended drought, flooding, temperature extremes, fire, etc.
• Failure to pick up merchandise without 30-day notice, contract is still in force and purchaser will be billed full amount for merchandise returned to Lodholz North Star Acres and held liable for full amount due.
• Any claims must be made within 5 days of delivery in writing.

LINING-OUT EVERGREENS SEEDLINGS AND TRANSPLANTS

Prices are F.O.B. Seller's nursery. Prices stated supersede all previous listings and are subject to change in whole or part without notice.

MINIMUM ORDER: No orders accepted for less than minimum shown below for any variety, age and size class. Seedlings and Transplants - 25 tree minimum.

SHIPMENT: All orders must designate the desired date of shipment. Where this information is omitted by the Buyer, the Seller, without assuming liability, will make shipment on or about the usual spring shipping period beginning April 15 according to the Seller's own judgement. When desired method of shipment is not specified on order, shipment will be made at Seller's discretion.

CERTIFICATE: Lodholz's North Star Acres, Inc. is a duly licensed nursery under the laws of the State of Wisconsin. Our nursery stock has been inspected and certified by the Wisconsin State Department of Agriculture.
